Ticket

 

Transportation is provided to passenger if

 

-He is in a possession of a valid ticket.

– His name is set as passenger in the ticket.

The ticket is valid only for the flights mentioned on it.

The ticket is not transferable nor salable.

The carrier reserves the right to verify the identity of the passenger. Thus, the passenger must be able to prove his identity at any time during his trip.

The passenger must use his tickets in the order of flight coupons. The passenger can’t therefore cancel one or more segments of its travels. In a return flight, the inbound coupon is usable only if the passenger has used his outbound copy..

The ticket is valid for transport one year (12 months) from the date of issue or one year (12 months) from the date of use of the first coupon.

According to fare conditions, changing the ticket may be allowed: Either the date of the flight, the airport of departure and / or destination can be changed.

In the case of a modification of a return ticket, the penalty of the cheapest fare class is the one that applies.

Passengers have no right of withdrawal for the purchase of their ticket.

Carrier’s name may appear abbreviated by its designator code on the ticket “BJ”.

The address of the carrier is deemed to be that of its head office.

 

Fares

 

Fares apply only for carriage from the departure airport to the destination airport via anystopper airport in case of indirect flight.

The rates do not include surface transportation between airports and between airports and town terminals.

The applicable fares are the fares calculated on the date of  ticket booking.

When booking, the passenger is informed of taxes, fees and other charges that will be charged in addition to the net fare.

When booking a ticket, the passenger must pay all fees, taxes or charges imposed by government or other authority, or by the operator of the airport.

These fees, taxes or charges may be created or increased by government or other authority, or by the operator of the airport after the date of ticket booking. In this case, the passenger must pay the amount, even if it has already paid the price of the ticket.

The VAT rates, taxes, emission charges and service fees are payable in the currency specified when booking.

However, the carrier may accept payment in another currency if specified by the carrier or its authorized agent. In this case, the carrier is entitled to set the exchange rate, taking into account the value of the currency on international markets.

The carrier may cancel any reservation in case of display error or technical error that makes the price of the bookingerroneous.

 

Reservations

 

Reservations are only confirmed starting from the recording of the booking in carrier system.

Some fare rates may be subject to conditions that limit or exclude the right to modify or cancel the reservation.

If the passenger has not paid for his ticket within the deadline set by the carrier, the carrier may cancel the reservation without assuming any liability.

The carrier will make every effort to grant the requested seats, but cannot guarantee the allocation of a given seat even if the booking is confirmed.

The carrier reserves the right to change the seat allocation at any time due to operationalneeds, safety or security, or in case of force majeure.

The type of aircraft mentioned to the passenger at the time of ticket booking or later is given as an indication.

The carrier reserves the right to change the type of aircraft without assuming any liability.

 

Personal Data

 

All personal data of passengers are collected and processed in accordance with nouvelair’s privacy policy.

 

Check-In and Boarding

 

Check-in time limit is 60 minutes prior to departure time.

Passengers must comply with the check-intime limit to facilitate their journey and to avoid cancellation of their bookings.

The passenger should be present at the airport three (3) hours before scheduled departure time so he can complete in time necessary formalities for his journey.

The carrier may without assuming any liability cancel the reservation of the passenger and the corresponding seat if passenger does not submit the necessary documents for his registration.

Passenger must be present at the boarding gate before the time mentioned on his boarding pass.

The carrier may cancel the passenger booking if passengeris not presentat the boarding gate at the specified time. In no case the carrier will delay the flight waiting for passenger.

 

Refusal and Limitation of Carriage

 

The carrier may at its discretion refuse to carry the passenger and baggage for reasons of safety or if one or more of the following cases has or is likely to occur

 

– The passenger does not comply with the applicable regulations.

– Physical or mental condition of the passenger could cause discomfort to himself or to other passengers or the flight.

– The transportation of the passenger and / or his baggage might endanger the safety, health or good order on board the aircraft, including if the passenger makes use of bullying behavior or uses abusive language against passengers or staff.

– The passenger is not able to prove that he is the person mentioned in the “Passenger Name” section of the ticket.

– The passenger has not paid ticket fare and / or issuing charges and / or any fees due.

– The passenger does not have valid travel documents.

– The passenger has a ticket acquired fraudulently.

– The passenger bought his ticket from a non-accredited agent.

– The passenger tried to illegally entering a territory during transit.

– The passenger has destroyed his travel documents during the flight.

– The passenger refused to produce his documents to the crew, when asked for.

– Thepassenger has not complied with the instructions and regulations concerning security or safety.

– The passenger who benefits from tariff discount or tariff subject to special conditions, is not able to produce the supporting documents required for granting this specific tariff or discount.

The passenger who has been denied transportation for one of the reasons above mentioned, is not entitled to a refund.

Unaccompanied children, pregnant women, the elderly, the disabled, the sick or anyone requiring special assistance can only be transported after prior approval of the carrier. The carrier reserves the right to require medical certificate.

Baggage

 

  General

 

The passenger declares that he knows the contents of his baggage and undertakes not to leave his baggage unattended.

 

   It is advisable to passenger to

 

– Avoid including in his baggage fragile items.

– Opt for hard shell baggage case.

– Remove previous flights labels from baggage

– Not include in his baggage: currency, jewelry, art objects, precious metals, silverware, securities or other valuable object, optical or cameras, computers, hardware or electronics and / or telecommunications, musical instruments, but also passports and identity papers, keys, business documents, manuscripts or securities, individualized or fungible …

The carrier is not responsible for the following items carried in checked baggage the passenger to his knowledge or not and which must be placed in hand baggage: medicines, perishable materials, funds, currency, jewelry, objects art, precious metals, silverware, expensive clothes, valuables or other precious object, fragile objects, optical or cameras, equipment or electronics and / or telecommunications, musical instruments, passports and identification documents, samples, business documents, manuscripts or securities, individualized or fungible.

 

Prohibited Items

 

It is not allowed for a passenger to:

 

 * Check a bag that does not belong to him, or that was given to him by someone else.

 * Carry in hisin checked baggage or cabin baggage, hazardous, flammable or liquids such as:

 

– Weapons and copies of weapons:

 

Weapons of all kinds, imitation firearms, parts of firearms (eg. Guns and play all kinds of guns, guns and turret guns, pistols and rifles industrial bolt and shot, crossbows , catapults, harpoon and spear guns, slaughtering guns, stun or shocking devices, lighters shaped gun …).

– Perishable food:

 

Perishable products such as fish, meat, vegetables, fruits, …

 

– Olive oil.

 

Right to refuse carriage of baggage

 

The carrier may, for reasons of safety and / or security, refuse to carry or continue to carry the baggage of the passenger if it contains the items listed above.

The carrier has no obligation to accept the deposit of the rejected baggage and / or articles.

The carrier may refuse to carry the baggage for which the passenger has refused to pay the required price supplements.

The carrier may refuse to transport baggage that has not been handed over by the passenger to the carrier before the check-in limit time.

Right of Inspection

 

For reasons of safety and/or security and/or at the request of the authorities, the passenger may be asked to conduct a search or control of his baggage.

If the passenger is not available, his Baggage may be searched in his absence, in particular to check if they contain prohibited items.

If the passenger refuses to comply with such requests, the Carrier may refuse to transport the passenger and its baggage.

 

Checkedbaggage 

 

When the carrier accepts a baggage for check-in, he will be responsible for the safekeeping of this baggage and he delivers to the passenger an identification label for each piece of the checked baggage.

baggage is transported on the same aircraft as the passenger, unless the carrier decides it is not feasible.

 

Uncheckedbaggage (Hand baggage)

 

Unchecked baggages are baggage taken into the cabin by the passenger. The passenger is solely responsible for his hand baggage.

Such baggage must be placed under the seat in front of the passenger or in an overhead compartment in the cabin.

One piece of hand baggage is allowed on board per person.

The maximum dimension of unchecked baggage is: 55cm x 35cm x 25cm.

 

Pets

 

The prior approval of the carrier is required for all carriage of pets.

The number of pets that can be transported is subject to a limitation

– Per passenger

– Per flight.

Carriage of some categories of pets is prohibited.

Animals traveling in the cabin are the animals that their weight and their traveling case do not exceed weight and dimensions limitations set by the carrier.

The passenger undertakes not to take the animal even partially out of its container for the duration of the flight.

Passenger must produce his pet’s valid documents required by the authorities of the country of departure, arrival and transit (passport, health and vaccination certificates and entry and transit permits)

The pet and his traveling case are not included in the baggage allowance. The passenger must pay an extra charge.

Service dogs and their container accompanying passengers with reduced mobility will be transported free of charge.

Passengers traveling with pets by not complying with the applicable regulations must reimburse the fines, loss, liability, and all sorts of costs supported by the carrier due such a situation.

The carrier is entitled, in all circumstances, to add its own additional requirements for transporting animals.

 

SCHEDULES, CANCELLATION, REPLACEMENT AND REFUNDS

 

– Flights and schedules mentioned in the carrier’s flight program are given for information for the passenger and have no contractual value.

The carrier reserves the right to make a schedule change and / or a new flight planning, however, any changes will be notified to the passenger in advance.

For operational reasons, the company reserves the right to change the route of flight including a stopover.

The passenger must provide the carrier with his contact information so he can be informed in case of flight schedule changes.

To avoid delays or flight cancellations, and after having informed the passengers, the carrier may assign the contract of carriage to another airline. The latter will be considered responsible for the flight and general conditions of carriage of that airline will apply to the flight.

The carrier reserves the right to cancel the flight at the latest two (2) weeks before the departure date. In this case the carrier offers the passenger a new travel date or reimbursement of the ticket price.

If the cancellation occurs less than two (2) weeks before the departure date, alternative transport will be provided by the Carrier

– The carrier will apply the EC 261/2004 regulation in the event of cancellation or delay of the flight.

In case of delay due to force majeure, the passenger is not entitled to alternative transport.

– The passenger, if it is allowed by ticket fare conditions, may request the modification or cancellation of the flight.

All requests of booking cancellation and / or modification addressed to Carrier’s call center will not be taken into account unless confirmed by email. The telephone conversation cannot be considered as a firm commitment to cancel/ modify a booking.

The cancellation/ modification of a booking generates management fees according to fare conditions. In the case of a return ticket, the penalty that is set on the cheapest fare class is the one that applies.

– Reimbursement will be made through the same means of payment used when purchasing the ticket.

The amount of taxes and government/airport fees related to purchased but unused tickets may be refunded if the passenger makes the request for reimbursement of these fees and charges within a maximum of three (3) months from the date of flight, mentioning the reservation number, passenger names and the date of travel. Without this information, the request will not be processed. Management fees will apply for the refund of taxes, government/airport fees.

Issuing service fees will not be refunded.

The passenger may make his refund request by contacting his travel agency, carrier point of sales and call center or through website and mobile application of the Carrier.

 

BEHAVIOR ON BOARD

 

The passenger must comply with the guidelines and recommendations of the crew so as not to compromise the security and safety of the aircraft and passengers.

The carrier may prohibit the use of electronic devices on board.

It is strictly forbidden to smoke (including electronic cigarettes) on board.

On board the aircraft, taking photos and / or videos is prohibited without prior authorization from the crew.

If the passenger fails to comply with the terms of this article, the carrier may proceed to the disembarkation of the passenger or take any restraining measures at any time of the flight.

SURFACE TRANSPORTATION

 

The carrier is not responsible for surface transportation.

 

ADMINISTRATIVES FORMALITIES

 

The passenger is requested to have all required travel documents in the country of departure, arrival and transit.

The passenger must produce to carrier

– All travel documents such as passport, all entry, transit and exit documents and authorizations.

– Health documents and any other documents required by the state of departure, destination and transit.

If admission on territory is refused, the passenger must pay all fees or fines imposed by the local authorities and the price of the transport.

The passenger is not entitled to reimbursement if its admission on territory is denied.

The carrier is not liable to the passenger for any loss or damage of baggage resulting from the refusal of the passenger to attend the inspection of his baggage by the authorities.

Passenger must undergo security/ safety checks required by the carrier as well as by government authorities.

 

LIABILITY FOR DAMAGES

 

The carrier’s liability will be determined by

 

– The carrier’s Conditions of Carriage

– The rules of liability under the Montreal Convention of 28 May 1999.

– The rules of liability under the EC 261/2004 regulation

In case of delay, damage or loss of baggage, the passenger must make a claim under the applicable procedures of the carrier.
